Constitutional Crisis

Constitutional Mandates Ignored
Our leaders swore an oath to defend and protect the Constitution. This has now become interpreted to mean defend and protect the United States. These are not the same things. Because they have become confused about what they are to protect they now think it is their job to rewrite the Constitution for the sake of nation.

As a result they are so zealous to write new laws that they don't even have time to read them before they vote on them! What insanity is this that we let our leaders pass laws without reading them?

Following are some examples of how they are ignoring the Constitution they swore to defend as though it were an outdated document fit for the 21st Century. They have become so superior in their own minds that they feel they don’t need to answer to anyone. Even worse if they are challenged it seems they will purposely do the opposite of what is desired. They have also decided it is time to begin to destroy the lives of those people who oppose them.

They are trying to take over companies as though the government has any right at all to own a company or run it. This is nothing more than fascism. This is not democracy or a democratic republic and it certainly isn’t Constitutional. On top of that consider these are people who are so responsible they voted for a trillion dollars in spending without ever reading the bill that would determine where or how that money would be spent. Do you want people like this running either the nation or even a company?

Below is a short list of Constitutional articles that have been ignored and set aside for the sake of doing what they want rather than what they should.

Article 2, Section 1
No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.

It has been said recently that our nation may be at a Constitutional crisis. I agree that this may be the case. We may be a point of crisis in several different ways. We have a man who has managed to become president without yet proving that he meets the minimum requirements for that office. Obama has yet to prove he is a natural born citizen. The media doesn't seem to feel there is any need for him to prove this either or at least they are refusing to report anything about it, hoping it will go away.

Obama has stonewalled every attempt to get copies of his school documents that may indicate that he got scholarships and grants and an alien. He has refused to release the originals of his birth certificate and has somehow convinced Hawaii that they should not release those documents to anyone.

Article 1, Section 9
The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.

This covers enemy combatants, and though the Constitution is clear about this our non-representing representatives do not seem so clear about it. We have come to some place that we do not feel we have a right to treat our enemies as anything but citizens without doing some harm to our Constitution in spite of the fact that our Constitution makes allowance for this. Our founding fathers understood that we would encounter times of war and have people fighting against us. They understood the dangers these people posted and made the determination that the laws protecting our citizens did not necessarily protect our enemies. Yet our leaders are incapable of recognizing the difference in these two situations. Our leaders have a hard time even recognize those that attacked our nation as enemies.

Article 1, Section 9
No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law; and a regular Statement and Account of the Receipts and Expenditures of ALL public Money shall be published from time to time

The treasury is required to give us an accounting of their expenditures for ALL public money, yet not even the congress can find out where over $300,000,000,000 went. The treasury behaves as though it were none of their business and the congress allows itself to be bullied.

Because we cannot get an accounting of where our money is going they could be doing anything with it. They’ve already shown us they don’t have much in the way of morals or ethics.

Article 1, Section 10
No State shall enter into any Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; coin Money; emit Bills of Credit; make any Thing but gold and silver Coin a Tender in Payment of Debts; pass any Bill of Attainder, ex post facto Law, or Law impairing the Obligation of Contracts, or grant any Title of Nobility.

Our money is supposed to be gold and silver coin, but our leaders decided this wasn't such a good idea in spite of what the Constitution says. Rather than amend the Constitution they simply ignore. What does this get us? We now have congress printing money as fast as they can which is going cripple our economy shortly. They should know this is the case, but they choose to ignore the danger. These men and women in congress seem to be under the sad misimpression that they are at least as wise, if not wiser than the founding fathers. I contend that if we had today's congressmen in office at the time the Constitution was written our nation would not have lasted even 50 years much less have grown to be the most powerful and richest nation on the earth. We have leaders that want to try political experimentation with things that have already been done and failed, yet they want to give them another try. This shows that our leaders cannot learn from the mistakes of others. I doubt they will even learn from their own mistakes.
We have a congress full of non-representing representatives who would have passed and ex post facto law impairing the obligation of a contract to pay bonuses in the case of AIG. They do not wish to preserve the constitution. They seek at every turn to sidestep it through lawyers and judges who redefine what it clearly says.

Article 1, Section 6
No Senator or Representative shall, during the Time for which he was elected, be appointed to any civil Office under the authority of the United States, which shall have been created, or the Emoluments whereof shall have been increased during such time; and no Person holding any Office under the United States, shall be a Member of either House during his Continuance in Office.

Here we have another example of congress ignoring an inconvenient Constitutional mandate because they don't like it. They wanted to have Senator Hillary Clinton as Secretary of State so they chose to ignore this mandate and just appoint her any way. The media did nothing to confront this and most of the people in the United States hardly even know where the various states are much less ever having read the Constitution.

Separation of Powers
The Constitution is clear about the separation of powers to prevent any one section of the government from becoming more powerful from the others and more or less staging a coupe. Our founding fathers understood the tendency toward corruption and the need for checks and balances.

They set things up so it would be very difficult for any one branch of government to usurp the powers of another. They understood that man desiring power as they do would fight to keep their own and thus prevent the other branches from gaining too much power. As mentioned above our judges have finally discovered that the laws passed by congress or any other legislative branch are meaningless in so far as they get to interpret the Constitution. All they have to do is declare any law unConstitutional and it is immediately cast out now matter how much the people want it. In similar manner no matter how much people oppose something they need only declare that they found the thing they want in the Constitution and it is instantly law. This does away with the need for the legislative branch.

Though this is never stated out loud the judges not only realize this is true but are acting on it more and more. Our judges have further come to realize that they are immune from the will of the people in another way. They do not have to worry about re-election. Once they are APPOINTED to their positions, it is for life or till they decide to retire. Being immune from this, they become bolder and bolder with each passing year taking more and more of the power appointed to others by the Constitution.

The congress still has a chance to take that power back, but not for long. Soon they will be forced to co-operate with judges or face their wrath. Our legislators have been emasculated whether they realize it or not. They may not even know how to get back the power they've been giving away for the last 4 decades or more. It has been a case of the frog in a pot of water being slowly boiled. They have not even seen what's been coming because they also viewed their job as one of making law after law and regulating everything they could think of. They lost sight of the ideal that they were there to defend and protect the Constitution not rewrite it.

Obama avoids having to have any of his people confirmed by the senate by calling them czars and giving them all the powers of the people who are supposed to fill appointments that need confirmation. Our democratic congress is willing to let this happen because it is in their favor not realizing it may not always be so. I’m sure they figure they will oppose a president they don’t like if he tries to do such a thing not realizing they might not have the power to do so. And so again the separation of powers is breaking down and our constitution is being compromised.
Freedom of Speech

At nearly every turn we are finding our Constitutional rights assaulted. Though it is not a frontal assault it is an assault nonetheless. The department of homeland security sent out a memo to all the law enforcement agencies in the United States telling law enforcement they needed to be watching and be careful of conservative right wing extremist groups. What does this mean? They don’t really clarify what this means. This is a typical beginning to propaganda wars where you plan on going after a group of people. You leave it as nebulous as possible so you can define it almost any way you want. What does this mean and who does it include? Again it is clear that it’s not clear.

Religious speech has so far been among the first and the most severely attacked. Of course most feel that religion is always fair game, at least till it is theirs. Further there have been many new forms of speech which have been declared hate speech. Anything that is considered hate speech can of course be prosecuted with nothing more than an accusation. For some reason as long as the attack doesn’t affect “me” no matter who that is then it is probably justified and needs to be addressed. The problem with this is that sooner or later it comes back to us as individuals but by the time it does anyone that might have stood with us to defend against the outrageous accusations is gone and can’t help us.

Taxes and the Military
Article 1 Section 8
To raise and support Armies, but no Appropriation of Money to that Use shall be for a longer term than two Years;

Our founding fathers were pretty careful to make sure that the government would not continuously raise taxes for the sake of keeping an army going constantly. They put in the Constitution that the raising of money couldn’t last more than 2 years so they would have to constantly reconsider whether the tax for the army should continue or not. Granted many things have Changed over the last 200 years. In our modern age there would not be time to raise an army should we be attacked. If we did not keep a standing army right now there would be little hope of retaliation should someone attack.

Still sense of what they put in the Constitution has merits and as they say we shouldn’t throw the baby out with the bath water. Because some aspects of this are not feasible still doesn’t indicate there aren’t dangers of having a standing army. It is also important that we recognize a need for some other laws to be put in place to prevent the admitted dangers of having a standing army on American soil. I am in great doubt as to whether our current leaders actually have the ability to effectively craft such a law in less than 10,000 pages.

The danger of having a standing army on American soil was that it might one day be used against its own people. We have lived in security so long that we feel such a thing would never be possible, but even a casual look at history shows us all the ways such a thing can happen.

We are now at a point where even some of our men in the military are questioning the right of Obama to be the Command in Chief. This is the stuff of coups. If a General or high enough ranking military leader questions the right of the leader to rule and decides to take it upon himself to do something about it then you have a coup. There is, at this point, some good reason to doubt Obama’s qualifications to hold his office based on the Constitution.

If the military knows it only gets its money through taxes and its money will run out shortly if they don’t have the full support of the people they are not likely to take such action as a coup because they will shortly have no money to feed their family. It is because of this reasoning that I believe the founding fathers put this provision into the Constitution.

The Oath of Office
Article 2 Section 1
Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation:--"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States."

It seems to be taken for granted that the president is to protect the Constitution of the United States, but I fear this has been reinterpreted to mean something it was never meant to mean. We think of this as meaning that the president will defend the United States, but this is not what it says. It says he will defend the Constitution. When our president says that we will have to submit to international law he is breaking his vow to defend to Constitution. This oath is not only to defend and protect but also to preserve the constitution. This means to keep the constitution from being changed or replaced in its basic meaning and purpose.

If the president at any time should cede some of our sovereignty to another nation or group of nations he is in violation of his oath and at that point it would be cause to impeach him for his actions.

There needs to be more concern about our president casting aside our Constitution in favor of international law and international/U.N. mandates. These other nations do not have a right to dictate laws in the United States and we should not be submitting to their Constitutions or laws. Treaties are one thing but to actually submit to their laws is to do away with the Constitution. If we don’t stand up for our Constitution we will not have it for long. We will lose what makes this country what it is. Not other constitution on the earth has recognized inalienable rights given by the God of the universe. This more than any other thing is the foundation of our constitution and our nation. I do not believe for a moment that our nation was primarily founded on Christian principles, but for the most part I think it was. At the very least many of the principles are based on Christian principles. Though many of our founding fathers were deists, and believed many things about God that might not be considered biblical strictly speaking even so I still think the principles were more or less based on the bible as it was one of the primary sources for morality for western civilization.

The very idea that we have a president who is willing to submit to international courts and allow for them to dictate even how we should bring up our children should be greatly distressing to every American, but for some reason people are simply viewing this as the next logical step in where the world is going. I’m not sure what it is about the way the rest of the world views us or has treated us that makes us feel in any way that they have our best interests at heart.

It is said but history seems to show us those who defend freedom most are the ones most likely to be vilified once they’re gone. Even the recipients of such freedom are frequently ready to attack those who bought it for them. Many seem to understand freedom apart from responsibility. They view freedom as good for nothing except the freedom to attack freedom. Consider the logic of this. If you wish to attack freedom and there for feel that you shouldn’t have it then on what basis do you bellow for your freedom to do this? Those who wish to burn the flag and are somehow offended that they might be forbidden to do so are in the same place. The flag is more than just a piece of cloth else they would just burn sheets or shirts. It is clear it is a statement that they despise what the flag stands for. This being the case they are essentially saying they despise the freedoms afforded by those under the flag. If this is so then they should not wonder or be angry if that freedom is taken away from them. Some may say that too them the flag represents the leadership of the nation, but this is not what the flag represents. It represents the basis by which we got those leaders. It represents the foundations that allow us the freedom to get rid of those leaders we don’t’ like.

Rather than desire to burn the very symbol of that right to vote and have democracy and freedom we ought rather to be getting rid of those who would take it from us. Probably more than any other thing, it mystifies me why people in this country would feel the constitution was imposed on them. Unlike every other totalitarian state Americans are free to leave if they don’t like it. I know many, unjustly, take offense at such a statement, but there is no reason to be offended. If they feel some other form of government found elsewhere in the world is a better government they have the freedom to leave this nation and emigrate to another. There is no reason to wreck havoc on this nation to try to make it like another when you can simply move to that other nation.

It is certainly not that they have some grand idea of a better government than this one that also does not exist elsewhere in the world. They only seek to destroy not to create at all. There is little to no reasoning in their responses. They are more about making a statement, but don’t even seem to know what that statement actually is. These are people simply looking for reasons to be offended and most any offense will do.

Our leaders have either lost all command of the English language or they are purposefully trying to take away yet more freedoms. In the G.I.V.E. bill HR 1388 they have mandatory volunteering. These two words are contradictory. Since it will be mandatory we should call it what it is, forced government service. Anyone who doesn’t see the danger this poses is more than willing to throw away every shred of freedom we’ve gained in the country. The people voting for this bill are not clear what its actual purpose is.

Homeland Security
It is a bit frightening that we are now seeing the Homeland Security that was set up under George Bush being used for the very things people feared it would be used for. Our homeland security is now targeting for investigation and for watch lists those they consider to be agitators. Most especially it has been determined these people are either only right wing people or that they are certainly mostly of that persuasion.

With the tea parties coming up across the United States and now listed as being in every major city of the country, there was a memo sent out to all law enforcement agencies across the nation to be on watch for these kinds of people. What can be next? Where will this all end? We are heading down a road most Americans were sure could never happen here and yet is a runaway freight train with no one at the Wheel.

Where will it all stop? It would seem there are only two ways for this to end. Either there is going to be a major move in this nation away from the kind of leaders we’ve had or we will come to a place of subservience. If our leaders are bold enough to begin to crack down on those that come to tea parties after the fact and the media does little or no reporting on those instances (as seems likely) then we will indeed see the end of democracy in our nation as we have known it. If instead the people continue to rise up and demand a turnaround from Washington then there may still be hope for our nation. Either way I think there is going to be a level of craziness in our time such as none in our generation has known.

When you have leaders who are of such position and mindset as to think they always know what’s best and don’t care about what the people want there is little you’re going to do to dissuade them. At this point our only real hope is that the military isn’t called out against the people.

There is a song called “We Must Take American Back” and from this song another book called taking America back; though I think there are many that are not satisfied with how things are going I get the impression that very few of them really know what they want. They want the high taxes to end, but when it comes to cutting any program they like they don’t want to give it up. This has been the same thing that has kept so many congressmen in office year after year in spite of 11% approval ratings. Till we know what we want there is little chance we will get it and it is for this reason I’m bettering our leaders don’t change their direction by even one degree. The media will continue, to some small degree, to say they’re not getting it, but nothing will change and our non-representing representatives will just continue on as they have before with not one of them being rousted from their place or certainly none but the worst. Even in saying this I’m not so sure it will be the worst to go. It seems the worst of them is even more isolated from being voted out then what ought to be called the best of them.

A New Revolution – One of Moral Character & A Return to God
Unlike special interest groups that go on for days, weeks and months till they get what they want I have a bad feeling that Tax day tea parties will be a onetime thing with no follow up until we get what we want. There is probably no man today who is more likely to raise the battle cry against rampant taxes and the taking of our rights than Alan Keyes. Though many people hardly know about him because the media has largely ignored him I believe that God is going to give him a platform and make him a central mover in what could well be a new revolution.

Alan Keyes is one of the few leaders of our day that understands It is as much about religion and God as it is about the Constitution He recognizes that without God the Constitution is nothing more than a man made document. He understands the moral problems of our current crisis. Everything else flows from that.

Our destruction or victory will be based on whether or not we return to God in repentance and learn to take a stand for both God and country. If we are not willing to do this we will have the government we deserve. We must understand that apart from the grace of God we do not deserve a great government or a place with God. We do not deserve the freedom God offers by His grace if we did deserve it, it wouldn’t be grace it would be debt. (Rom 4:4,5 & 5:8)

The message of the tea parties needs to be “Throw the bums out!” and “No more tax money from us till you leave!” We need to remember that we are Americans and stop allowing our leaders to divide us against each other. Jesus said, “a house divided against itself cannot stand.” This we know is an absolute and true statement. It is the reason our worldly non-representing representatives are so bent on silencing religion. They do not seem to understand that the Constitution does not tell them they cannot talk about religion or even against it. What the constitution says is that they cannot make any LAWS for or against religion.

God said in His word the following and there is little doubt that it is true. Eventually we shall see the judgment of God if we do not repent and submit to God and seek only His glory. I know judgment is never a popular subject not even in church anymore.

Deut. 32:35 To me belongeth vengeance, and recompence; their foot shall slide in due time: for the day of their calamity is at hand, and the things that shall come upon them make haste.

Lam 3:2 It’s of the Lord’s mercy that we’re not consumed.

Psa 31:9 Have mercy upon me, O LORD, for I am in trouble: mine eye is consumed with grief, yea, my soul and my belly.

Nation at the Crossroads
A revolution of some kind is coming. The question is whether it will be bloodless where the leaders succumb to the will of the people or whether they will turn on the people and do what so many people in power have done in the past. We may have yet caught this just in time, but only time will tell.

This could go either way at this point. Many other nations in the past have come to this point and not survived it. To some degree I believe we are a nation of survivors, but to some degree I also believe we have become a nation of lazy sheep willing to go along to get along. This was not the ethic of our forefathers, but it seems to be the ethic by which we live today.
We have allowed our leaders to do things we never thought they would do. We have not called them to account for what they’re doing with our money. We haven’t told them to stop taxing us. We keep letting them go on with the taxes as much as they please. They finally decided to go for the big grab and it seems they may have overplayed their hand this time. They may have gone too far. This is one of the few times I’ve hoped they have gone too far. It may cause some short term problems as far as taxes and government go, but if the end effect is that we get our government back then it will not have been for nothing. Most don’t even consider that we demand they reverse those bills and stop the madness.

As many of our constitutional rights are being ceded to the international community we are watching the very thing happen we thought never could. Our leaders who are sworn to uphold, protect and preserve the constitution are dismantling it as quickly as they can. They behave as though they have good reason to do so, but the reality is they have no good reason other than that they think they can do government better than our founding fathers.

Obama’s lack of concern for the constitution speaks volumes. I believe it also says a lot that Obama felt it necessary to cover any religious symbols when he spoke at the university. He knew it was a catholic college and it seems more it was about poking them in the eye for not giving him an honorary diploma. The man says he’s a Christian so it should in no way have offended him and indeed if he views Christ as the Lord he would defer to him and make sure the people knew that God was his Lord, but instead he sought to cover every symbol of Christianity he could when he spoke.

At nearly every turn it seems Obama is trying to find ways to get around the constitution. In some cases he simply ignores it and stonewalls when called upon to produce evidence required by the constitution. In other cases he has decided that the constitution is to submit to international law and that international law is the higher of the two. In yet other cases he overcomes the constitution by appointing czars for positions that should be cabinet positions to be reviewed and affirmed or denied by the congress. It seems the congress is more than willing to give its power to the president and not exercise the power and responsibility given to them by the constitution. It may be that our leaders real don’t know, or care about the constitution. Either way it is a frightening prospect. Our congress may find, too late, that they no longer hold any power at all and are only figureheads in a government out of their control.
